These Terms of Service ("Terms") govern access to and use of Defsight.com and all related products, platforms, dashboards, reports, newsletters, and services (collectively, the "Services") operated by Bytewerk FZE ("Company", "we", "us", "our").

By accessing or using the Services, you agree to be legally bound by these Terms. If you do not agree, you must not access or use the Services.

2. Nature of the Services

Defsight is a business-to-business defense market intelligence and analytics platform.

The Services are based exclusively on:

  • Open-source information
  • Publicly available data
  • Commercial and corporate disclosures

Defsight does not provide classified information, controlled military data, legal advice, investment advice, procurement advice, or government decision-making support.

3. Eligibility and Accounts

3.1 Eligibility

You must:

  • Be at least 18 years old
  • Use the Services solely for professional or business purposes
  • Have authority to bind the organization you represent (if applicable)

3.2 Account Registration

You are responsible for:

  • Providing accurate and current information
  • Maintaining the confidentiality of your login credentials
  • All activity occurring under your account

Account sharing, credential resale, or access by unauthorized users is strictly prohibited.

3.3 Account Suspension and Termination

We reserve the right, at our sole discretion, to suspend or terminate access to the Services without prior notice if we reasonably believe:

  • These Terms have been violated
  • The Services are being misused or abused
  • Continued access poses legal, security, or commercial risk

4. Subscriptions, Billing, and Payments

4.1 Paid Services

Certain Services require a paid subscription. Pricing, features, and billing intervals are presented at the time of purchase.

4.2 Payment Processing

Payments are processed by Stripe. We do not store full payment card details.

4.3 Recurring Billing

Subscriptions automatically renew unless canceled before the renewal date.

4.4 No Refunds

Except where required by law, all fees are non-refundable, including for unused time, downgraded plans, or terminated accounts.

We reserve the right to modify pricing or subscription structures with prospective effect.

5. Intellectual Property and License

5.1 Ownership

All content, including but not limited to:

  • Reports
  • Databases
  • Dashboards
  • Text, graphics, charts, and visualizations
  • Methodologies and data structures

are the exclusive intellectual property of Bytewerk FZE or its licensors.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes only.

5.3 Restrictions

You may not:

  • Copy, scrape, harvest, or download content at scale
  • Redistribute, resell, sublicense, or publish content
  • Use the Services to train AI or machine learning models
  • Reverse engineer or attempt to extract source data or logic
  • Circumvent access controls or usage limits

6. Acceptable Use and Compliance

You agree not to use the Services:

  • In violation of applicable laws or regulations
  • For export control or sanctions evasion
  • To misrepresent data as official, classified, or government-endorsed
  • To harm, interfere with, or disrupt the Services or other users

You are solely responsible for ensuring your use complies with all applicable export control, sanctions, and trade laws.

7. No Warranties

The Services are provided "as is" and "as available".

We make no warranties or representations regarding:

  • Accuracy, completeness, or timeliness of information
  • Fitness for a particular purpose
  • Availability or uninterrupted operation

Information provided is informational only and must not be relied upon as legal, financial, procurement, or strategic advice.

8. Limitation of Liability

To the maximum extent permitted by law:

  • Bytewerk FZE shall not be liable for indirect, incidental, consequential, special, or punitive damages
  • Total liability shall not exceed the total fees paid by you to Bytewerk FZE in the twelve (12) months preceding the claim

This limitation applies regardless of the legal theory asserted.

9. Indemnification

You agree to indemnify and hold harmless Bytewerk FZE from any claims, damages, liabilities, losses, or expenses arising from:

  • Your use or misuse of the Services
  • Violation of these Terms
  • Violation of applicable laws or regulations

10. Third-Party Services

The Services may integrate or link to third-party services. We are not responsible for third-party content, systems, or practices.

11. Confidentiality

Non-public information disclosed to you through the Services is confidential and may not be disclosed to third parties without our prior written consent.

12. Changes to the Services or Terms

We may modify or discontinue the Services at any time.

We may update these Terms from time to time. Continued use after changes constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, excluding conflict-of-law principles.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts of the United Arab Emirates.

14. Severability

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.
